TERMS & CONDITIONS MARIA CLEANING
These terms and conditions (the “Agreement”) set out the rights and obligations between you (the “Customer”) and Maria Cleaning Pty Ltd (“Maria Cleaning”), for the provision of cleaning services (the “Service”) to the Customer. By booking and using our services, you agree to be bound by these terms and conditions.
Section 1:
1. Cleaning Services
Subject to the terms of this Agreement, Maria Cleaning agrees to provide cleaning services (the “Service”) at the location specified by the Customer (the “Premises”). The scope of the Service will be as agreed between the Customer and Maria Cleaning at the time of booking.
Maria Cleaning will send one or more cleaners (the “Cleaner(s)”) to perform the Service at a mutually agreed time and date (the “Service Time”). Maria Cleaning will perform the Service professionally, efficiently, and in accordance with industry standards. To provide efficient service, Maria Cleaning reserves the right to send two cleaners to your home. This allows us to complete the cleaning in less time while maintaining high-quality standards. For instance, if you book a 2-hour cleaning service, two cleaners will each work for 1 hour, ensuring you receive the full 2 hours of service while reducing overall time spent.
2. Additions and Amendments
Any changes or additions to the Service must be agreed upon with Maria Cleaning prior to the Service Time. If the Customer requests additional services or modifications to the agreed service during the performance of the Service, the Customer must communicate with the Cleaner(s) on-site or contact Maria Cleaning. Additional charges may apply, and acceptance of such services is at the discretion of the Cleaner(s).
3. Customer Representations and Warranties
The Customer represents and warrants that:

The Premises are safe for the Cleaners to perform the Service.

The Customer will provide unencumbered access to all areas requiring cleaning.

The Customer will provide all necessary utilities (hot/cold water, electricity, rubbish disposal) for the Cleaners to complete the Service.

All cleaning equipment and materials provided by Maria Cleaning team are in good working order and safe to use.

The Customer will notify Maria Cleaning in advance of any hazards, slippery surfaces, or risks at the Premises.

The Customer has authorization to allow Maria Cleaning to provide the Service at the Premises.

Any valuable, fragile, or sentimental items will be secured or removed prior to the Service.

The Customer will let the team know in advance of any product allergies and if it is the case to use Customer products.
4. Health and Safety
The Customer acknowledges and agrees that:

Cleaners may perform a risk assessment before beginning the Service to ensure a safe working environment.

If, during the Service, the Cleaner(s) determine that there are health and safety risks, they have the right to cease or refuse the Service in their sole discretion.
5. Engagement of Cleaners
The Customer agrees not to directly or indirectly engage or employ any Cleaner employed by Maria Cleaning for domestic services during the period of service provision or for 12 months following the last Service. This clause protects the interests of Maria Cleaning, which invests significant resources in recruitment and training of its staff.
6. Quotations and Pricing
The cost of the Service will be based on factors such as the size of the Premises, the number of rooms or items to be cleaned, and the type of Service required. Maria Cleaning provides estimates based on information provided by the Customer. Prices are valid for 3 days from the date of quotation.
Minimum Call-Out Fee: Minimum of 2 hours working (including GST). If the cost of the requested Service is less than the minimum fee, the Customer will still be charged the minimum call-out fee.
If the actual cost of the Service exceeds the original quote, Maria Cleaning will inform the Customer and seek approval to continue the Service at the new cost.
7. Booking Process
The Customer may book the Service by phone, email, text message, or via the Maria Cleaning website. When booking, the Customer must provide all relevant details regarding hazards, risks, and cleaning needs. Maria Cleaning reserves the right to reject any booking at its discretion.
8. Payment Terms
The Customer agrees to pay for the Service in full before or at the end of the Service Time, unless otherwise agreed. If the Customer opts to pay after the Service, a deposit of 50% of the quoted price is required before the Service begins. Payments may be made via bank transfer, cash, or EFTPOS (processing fees may apply for card payments).

Late payments may incur a fee, and failure to settle the payment may result in debt recovery proceedings at the Customer's expense.
9. Late Payment Fee
If payment is not received within 3 days of the invoice date, Maria Cleaning reserves the right to charge interest and recovery costs. The Customer agrees to indemnify Maria Cleaning for any legal costs and debt collection fees incurred.
10. Complaints and Service Guarantee
If the Customer is dissatisfied with the Service, they must notify Maria Cleaning within 24 hours of service completion. Maria Cleaning will strive to resolve the issue and may offer a re-clean or rectification of the issue free of charge, provided the conditions of this Agreement have been met.
11. Exclusions and Limitations
The Service guarantee is valid for 24 hours from the completion of the Service, subject to the following conditions:

The Premises have not undergone any renovations or repairs after cleaning.

The Premises remain vacant after cleaning.

No damage has occurred to the Premises post-cleaning.
-
The conditions at the Premises were accurately disclosed to Maria Cleaning before the Service.
Maria Cleaning is not liable for:

Damage or loss caused by faulty equipment or materials provided by the Customer.

The inability to complete the Service due to the Customer’s failure to provide access or utilities.
-
Loss or damage due to force majeure (events beyond our control).
-
Stains, wear, or discoloration that cannot be removed through cleaning.
12. Indemnity
The Customer agrees to indemnify Maria Cleaning against any loss, liability, or damage arising from a breach of this Agreement, including but not limited to failure to provide a safe working environment or unencumbered access to the Premises.
13. Accidents, Breakage, Damage, and Theft
The Customer must inform Maria Cleaning of any breakage, damage, or theft within 24 hours of the Service completion. Damage to fragile, valuable, or sentimental items is not covered unless explicitly caused by the Cleaner’s actions. Maria Cleaning has insurance to cover accidental damage reported within 24 hours.
14. Insurance
Maria Cleaning maintains insurance to cover accidental damage caused during the Service. However, it does not cover damages to appliances that are not functioning properly or securely.
15. Cancellation and Rescheduling
The Customer must provide at least 24 hours’ notice if they wish to cancel or reschedule the Service. Failure to do so will result in a cancellation fee equivalent to 50% of the total agreed. If the Cleaner is unable to access the Premises, a fee will also apply.
16. Termination
Either party may terminate this Agreement with 24 hours' notice. Maria Cleaning may terminate immediately if the Customer breaches any part of this Agreement.
17. Privacy Policy
Maria Cleaning will use the Customer’s personal information solely for the purpose of providing the Service and will not share such information with third parties without the Customer’s consent, except as required by law.
18. Changes to Agreement
Maria Cleaning reserves the right to modify these terms at any time. Any updated terms will take effect 24 hours after being posted on the website.
19. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of Western Australia, and any disputes shall be resolved in the courts of Western Australia.
20. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
Section 2: Maria Cleaning Voucher Terms and Conditions
1. Voucher Issuance and Validity
1.1 This voucher is issued by Maria Cleaning and is valid for 6 months from the date of issue.
1.2 The expiration date is clearly stated on the voucher and cannot be extended.
1.3 Expired vouchers will not be accepted, and any unused value will be forfeited after the expiration date.
2. Redemption of Vouchers
2.1 Our team will reach out to the recipient of the gift to arrange a convenient appointment time.
2.2 The voucher can be redeemed for any cleaning services offered by Maria Cleaning.
2.3 The voucher can only be used once and must be applied during the booking process.
2.4 Bookings are subject to availability and should be made in advance. We recommend booking early to secure your preferred time.
2.5 The voucher cannot be used for special offers, bundled services, or third-party services.
3. Restrictions on Use
3.1 This voucher is non-transferable and can only be used by the individual to whom it was issued.
3.2 The voucher may not be exchanged for cash, credit, or any other form of compensation.
3.3 The voucher can only be used for the specified services and value. Any service or additional charges above the voucher's value must be paid for at the time of service.
3.4 Only one voucher may be applied per transaction. It cannot be combined with any other promotional discounts, offers, or vouchers.
3.5 The voucher can only be redeemed once and is not reusable once used for a booking.
3.6 The voucher is only valid for properties located within Maria Cleaning’s regular service zones. Please check the coverage map here
4. Changes to Services and Bookings
4.1 Maria Cleaning reserves the right to modify or discontinue the services offered under this voucher at any time.
4.2 All bookings are subject to availability. If we are unable to fulfill a requested booking, we will provide alternative dates or times.
4.3 In the event of any cancellation or rescheduling, customers must adhere to Maria Cleaning's standard cancellation policy.
4.4 If a booking is canceled within the cancellation period (as per our company policy), the voucher will be reinstated, and you may rebook at a later date, subject to availability.
5. Refunds and Cancellations
5.1 This voucher is not refundable, and no refunds will be issued for any unused portion.
5.2 If a booking is canceled with less than 24 hours' notice, a cancellation fee of 50% of the total service cost will apply, in accordance with our company policy.
5.3 Cancellations of services booked using the voucher must follow Maria Cleaning's standard cancellation and refund policy.
5.4 If a service is canceled by Maria Cleaning, an alternative date for the service will be provided or a full refund will be issued.
6. Voucher Value and Balance
6.1 The value of the voucher is stated at the time of issuance. Any remaining balance after the voucher is applied will be credited toward the next appointment.
6.2 If the total cost of the service exceeds the value of the voucher, the customer is responsible for paying the difference.
6.3 Vouchers cannot be used to cover tips, taxes, or any other charges not explicitly covered in the terms.
7. Liability and Disclaimers
7.1 Maria Cleaning is not responsible for any damages or losses incurred due to the use of this voucher, except as required by law.
7.2 The voucher is provided "as is," and no warranties are made, either express or implied, with regard to its fitness for a particular purpose.
7.3 Maria Cleaning does not accept liability for any indirect, incidental, or consequential damages arising from the use of the voucher.
8. Changes to Terms and Conditions
8.1 Maria Cleaning reserves the right to modify or amend these terms and conditions at any time without prior notice.
8.2 Any updates or amendments will be reflected on this page, and it is the responsibility of the voucher holder to check these terms regularly.
8.3 Continued use of the voucher after changes to the terms constitutes acceptance of the new terms.
9. Governing Law
9.1 These terms and conditions are governed by and construed in accordance with the laws of Western Australia, and any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.
